Mel Gibson can sue whomever he wants, but really, hasn't the damage been done...again?

The actor-turned-raving-madman is reportedly considering suing screenwriter Joe Eszterhas for secretly recording a profanity-riddled rant while at Mel's home in Costa Rica last December, then releasing the audio tirade, which was recorded on an iPod by Eszterhas' teenage son.

The rant reportedly consists of Mel exploding over Eszterhas' lack of progress with the script for the actor's latest biopic about a Jewish warrior, "The Maccabees," which the screenwriter claims Gibson never actually intended to make because he "hates Jews."

"Why don't I have a first draft of The Maccabees? What the - have you been doing!?" the voice on the tape explodes, before also unloading on ex-girlfriend Oksana Grigorieva, calling her a "whore," among other names.

On April 11, a scathing letter Eszterhas wrote to Gibson was leaked on The Wrap, in which he accused the 56-year-old actor of making horrific anti-Semitic and lewd remarks in front of 15-year-old son, Nick.

TMZ.com reported that Gibson's camp are looking at the laws of Costa Rica to determine if recording laws were violated and, even if they weren't, if Mel's right of privacy was violated by the release of the audio.

Sources connected with Gibson also told the site that the actor believes he has a basic human right not to be clandestinely recorded in his own home.

In case you've forgotten, Gibson came under fire in 2006 when he launched into a drunken anti-Semitic rant after he was pulled over by cops.
