Judge: Soho’s ‘The Wall’ stays

A federal judge has upheld an October 2000 decision by the city’s Landmarks Preservation Commission that the owner of 599 Broadway cannot remove Forrest Myers’ “The Wall,” a 1973 public artwork, from the side of the building at the southwest corner of Broadway and Houston St.

In her Sept. 10 ruling, Judge Deborah A. Batts dismissed the owner’s First Amendment claims, arguing that the artwork’s presence was not necessarily burdensome. The building’s owner had argued that the support bolts on the wall’s exterior — to which the artwork is attached — were causing leaking.
